This appeal follows a suit filed by appellants, who are non-executive owners of a portion of a four-fifth (4/5) interest in the mineral estate of certain lands located in McMullen County, Texas. Appellants sought to recover from appellees their share of overriding royalties assigned to Johnie Lorene Acker and her husband, Edwin V.
