ALFORD, Judge.
Earl Peters was indicted by the St. Helena Parish grand jury for first degree murder, in violation of La. R.S. 14:30. On the day trial began, the state amended the first degree murder indictment to a charge of second degree murder. Defendant was tried by a jury, which convicted him as charged.
