In this miscellaneous proceeding, the court is asked to determine whether decedent's surviving spouse is entitled to a community property share of her husband's estate (EPTL 6-6.1 — 6-6.6). This is the first case construing in an estate proceeding the Uniform Disposition of Community Property Rights at Death Act since it was adopted by this State in 1981 (L 1981, ch 187).
