DUDLEY, Justice.

The appellant was convicted of first degree murder, theft by receiving, and fleeing. The theft by receiving conviction was merged into the murder conviction, and therefore, appellant was sentenced only for first degree murder and fleeing. The appellant's primary point on appeal is that the only crime he can be convicted of is second degree murder. We affirm the judgments of conviction as set out by the trial court.
