GIERKE, Justice.

The defendant, Lloyd T. Moen, was charged with the crime of driving while under the influence of alcohol in violation of Section 39-08-01 of the North Dakota Century Code. Moen entered a conditional plea of guilty pursuant to Rule 11(a)(2) of the North Dakota Rules of Criminal Procedure1 and appealed from the final judgment entered by the county court on January 24, 1988. We affirm.
