The defendant, Gordon Gabriel, was charged by bill of information filed on October 28, 1983 with armed robbery in violation of LSA-R.S. 14:64. The defendant was arraigned and he pled not guilty. Trial was conducted on March 20, 1984, but a mistrial resulted when the jury failed to agree on a verdict. A second trial began on September 10, 1985.
