On December 22, 1988, in an unpublished per curiam opinion, we reversed a judgment dismissing the plaintiff's complaint against the defendant and his insurer and remanded the matter for further proceedings. The defendants petitioned the supreme court for review. The supreme court granted the petition and remanded the matter to us "for further consideration in light of this court's decision in State v.
