ALVIN B. RUBIN, Circuit Judge:

At issue is the timeliness of two filings: the notice of appeal invoking the jurisdiction of this court, and the underlying charge of discrimination with the Equal Employment Opportunity Commission requisite to invoking the jurisdiction of the district court. We hold both filings timely, reverse the judgment, and remand the case to the district court.
