Appellants, the Civil Service Commission of the City of Baytown and the City of Baytown, contest a judgment entered by the trial court overturning the commission's decision that appellee, Cecil Clemmer, was properly passed over and not promoted to the position of assistant chief within the Baytown Fire Department.
