Jan and Tekla Matejski are the legal guardians of their thirty-three-year-old mentally retarded daughter, Helen. On May 28, 1986, Jan and Tekla filed an application seeking a court order which would permit them to have Helen sterilized. Helen's court-appointed counsel followed with a motion to dismiss, challenging the district court's subject matter jurisdiction.
