KLEES, Judge.

Defendant, Robert Vidrine was charged by bill of indictment with the second degree murder of his girlfriend, a violation of LSA-R.S. 14:30.1. After a judge trial, he was found guilty of manslaughter, a violation of LSA-R.S. 14:31 and sentenced to four (4) years at hard labor. From this conviction and sentence, defendant appeals.
