John W. Moore and his political party contend that § 10-4 of the Illinois Election Code, Ill.Rev.Stat. ch. 46 § 10-4, violates the first amendment to the Constitution. Section 10-4 prevents anyone from collecting signatures on behalf of different parties during the same election season. It kept Moore out of the race for the Illinois House of Representatives in 1982, because Moore first qualified for and then withdrew from a primary...
