On September 29, 1985, petitioner was operating a motor vehicle northbound on State Route 12 in Lewis County when he struck a 20-month-old infant who darted out onto the highway. The child died as a result of the accident. Petitioner was not issued any traffic tickets as a result of the accident. There was no evidence of prior vehicular infractions. However, the Department of Motor Vehicles held a hearing pursuant to Vehicle and Traffic Law...
