This case comes before the Court on plaintiff's application for a temporary restraining order and a preliminary injunction. Plaintiff, The TREASURER, seeks to prevent Philadelphia National Bank [hereinafter PNB] from acquiring the assets of Mellon Bank's "CashStream" network and to ban enforcement of certain provisions of PNB's servicing agreements.
