This bankruptcy appeal presents legal questions relating to Hawaii's interpretation of sections 5 and 9 of the Uniform Fiduciaries Act (UFA), Haw.Rev.Stat. §§ 556-4, 556-8 (1985). The trustee in bankruptcy of an investment firm brought suit in federal district court against the Bank of Hawaii ("Bank") for money allegedly disbursed by the Bank in violation of the UFA.
