OPINION

CHAPA, Justice.

Appellant, Floyd Elliott Williams, was convicted by a jury of attempted capital murder. Punishment was assessed at 99 years' confinement. Appeal has been perfected to this Court. We reverse and remand.

The critical issue is whether the trial court erred in refusing appellant's requested charge on the lesser and included offense of aggravated assault. Because we agree the refusal was reversible error, we will not address the...
