MEMORANDUM OPINION

BEER, District Judge.

Carlos J. Aviles was a Yeoman Second Class in the United States Coast Guard. In mid-October 1986, he was tested for the Human Immunodeficiency Virus ("HIV")1 during a mandatory Coast Guard physical examination. The test was positive, and resultingly, the Coast Guard compelled Mr. Aviles to retire with a 30% disability rating.
