Defendant Sterling Benjamin and co-defendant Herbert Thomas were charged with the commission of the crime of armed robbery perpetrated against Dr. and Mrs. Gilbert Goldman. La.R.S. 14:64. Herbert Thomas pled guilty and was sentenced to two concurrent 22 year sentences. Sterling Benjamin was tried by a jury and found guilty as charged. He was sentenced to two concurrent 35 year sentences. He appeals his conviction and sentence on the basis of one assignment...
