BRYNER, Chief Judge.

Mitchell Straetz drove a Honda three-wheeler on University Avenue in Fairbanks on December 7, 1987, while his license was in suspended status for failure to obtain SR-22 insurance. He was charged with driving while license suspended (DWLS) in violation of AS 28.15.291(a). He filed a motion to dismiss prosecution, which was granted by District Court Judge Christopher E.
