This matter is before me on the Defendants' motions for summary judgment. The Plaintiff, Robert Pachaly, Jr., filed his complaint on February 16, 1988, alleging the City of Lynchburg, R.D. Viar, the Commonwealth of Virginia, and William G. Petty converted property and violated the Plaintiff's civil rights pursuant to 42 U.S.C. § 1983.
