Plaintiff Flute, Inc. ("Flute") has moved for a default judgment against defendants Blair Rubel ("Rubel") and Blair Rubel, Ltd. ("Rubel Ltd.") for failure to answer or otherwise plead and in the alternative for summary judgment pursuant to Rule 56 Fed.R.Civ.P.
