Johnny Elias-Rivera (Elias) is an attorney who was charged with embezzlement of funds from two bankrupt estates in which he was appointed as trustee.1 He was convicted on two embezzlement counts, one for each estate. He challenges his embezzlement convictions on the grounds of insufficient evidence. We agree that the evidence was insufficient to establish the essential elements of the embezzlement counts...
