A jury trial resulted in a conviction of appellant of Murder for which he received a sentence of fifty (50) years.

The facts are: On June 25, 1986, Fred Brown, Charles Brown, the appellant in this case, and Walterkeith Chapman were at the home of Fred Brown where they played cards and drank both whiskey and wine.
