In this discretionary review, the State challenges the legality of the sentence imposed upon defendant Roberto Socarras by the trial court. After a jury trial, the defendant was found guilty of OWI, second offense, in violation of Iowa Code section 321J.2. The trial court sentenced the defendant to ninety days in jail, with all but ten days suspended. It did not order the revocation of the defendant's driver's license for six years nor did it impose...
