Kenneth Hardy was convicted of murder and sentenced to death. This court affirmed his conviction in Hardy v. State, 245 Ga. 272 (264 S.E.2d 209) (1980). At trial the district attorney, who is now deceased, quoted passages from Eberhart v. State, 47 Ga. 598, 610 (1873) and Hawkins v. State, 25 Ga. 207, 211 (1858), to the jury.
