Defendant Balch, Hardy & Scheinman, Inc. ("Balch, Hardy") has moved by order to show cause to dismiss the complaint in this action for lack of subject matter jurisdiction on the ground that plaintiff Richard J. Brignoli ("Brignoli") is a citizen of the State of New York, not of Connecticut, and thus diversity between parties is lacking.
