STRAUSBAUGH, J.

This is an appeal by plaintiff from a judgment of the court of common pleas denying injunctive relief. The court, upon plaintiff's motion for preliminary injunctive relief, consolidated the hearing as to the preliminary injunction with the merits for permanent injunctive relief. At the close of plaintiff's case, the trial court dismissed that branch of the complaint on defendant's oral motion.
