As to the defendant Haynes, the People acknowledge that the hearing court erred in denying, without a hearing, his timely filed written motion to dismiss on the claim that he was denied a speedy trial pursuant to CPL 30.30. The hearing court's denial was apparently based on the then widely held interpretation of People v Giordano (56 N.Y.2d 524) as holding that delay subsequent to the People's announcement of readiness for trial...
