REES, J.:

Defendant John Griblin appeals from his jury conviction of voluntary manslaughter, a class C felony (K.S.A. 21-3403). We reverse.

We conclude that resolution of one of the nine issues raised by defendant is dispositive of this appeal. Accordingly, we will address that issue only.

Defendant was tried on a charge of second-degree murder, a class B felony (K.S.A. 21-3402). The jury was instructed on the elements of second-degree murder, voluntary...
