Emilda Davis was allegedly injured on November 23, 1984, when a shopping cart overturned on her right foot while shopping at a Winn-Dixie store in Lafayette, Louisiana. She brought this damage suit against defendant, Winn-Dixie Louisiana, Inc. (hereafter Winn-Dixie). Defendant filed a third party demand against Unarco Commercial Products, Inc., the manufacturer of the shopping cart.1
