Consequently, any error with respect thereto has not been preserved for appellate review (see, CPL 470.05 [2]; People v Williams, 46 N.Y.2d 1070), and we decline to exercise our interest of justice jurisdiction in this instance.

We further decline to modify the sentence imposed...
