Noyes Russell Howard was convicted of the first degree murder of his wife, Donna Howard. He appeals contending the court should have dismissed the charge because (1) the State failed to preserve potentially exculpatory evidence in violation of his due process right to a fair trial; and (2) the delay between the victim's death and the trial was prejudicial.
