MILLIGAN, Judge.
Plaintiffs, husband and wife, sought a declaratory judgment in the Stark County Common Pleas Court. The husband, Richard L. Nussbaum, negligently drove his insured automobile causing injuries to his passenger, his wife, Julia E. Nussbaum.
