Ordered that the judgment is affirmed.

We find that the defendant's conduct constituted the crime of scheme to defraud in the first degree (see, Penal Law § 190.65). Testimony at trial established that the defendant engaged in an identifiable pattern of behavior which was reasonably calculated to deceive.
