Appellant, Paul D. Toney, was convicted by a Baltimore City jury of second degree murder, use of a handgun in the commission of a crime of violence and unlawfully wearing and carrying a concealed deadly weapon. For the second degree murder and the handgun convictions appellant received concurrent twelve year sentences, of which seven years were suspended with the direction that he be placed on probation for five years after the period of incarceration...
