Ordered that the order is modified, on the law, by granting the motion of the defendant Henry Weiss individually and doing business as Gigi Handbag & Novelty Co. for summary judgment dismissing the complaint and the cross claims as against him; as so modified, the order is affirmed insofar as appealed from, with costs to the defendant Weiss payable by the plaintiffs.
