This appeal grows out of events surrounding an altercation between the defendant Joseph R. LaPointe and his girlfriend R.N. on February 21, 1986. Defendant was indicted and tried on four criminal charges. Following a trial to the court, defendant was acquitted of two of the charges and was convicted and sentenced for a lesser and included offense of assault causing bodily injury in violation of Iowa Code section 708.2(2) (1985), a serious misdemeanor...
