The defendant, Billy B. Tucker, was charged in the circuit court of Kendall County with the murder of Kevin Neuman (Ill. Rev. Stat. 1985, ch. 38, pars. 9-1(a)(1), (a)(2)) following a shooting at T's Tap, a tavern, in Plano, Illinois. The jury was instructed as to the offenses of murder and involuntary manslaughter and on the defendant's theory
