Defendant Bienvenido Diaz was first tried and convicted of "trafficking in more than 10,000 pounds of marijuana" in January 1985. Upon appeal, the North Carolina Supreme Court granted defendant a new trial. State v. Diaz, 317 N.C. 545, 346 S.E.2d 488 (1986).
