Defendant, Kenneth Trammell, was convicted by a jury of gross indecency between a male and female,1 and subsequently pled guilty to being an habitual offender, third offense.2 He was sentenced to a term of four to ten years imprisonment by the Muskegon Circuit Court and now appeals as of right, arguing that the trial court erred in denying his motion for a directed verdict of acquittal.
