This is a death penalty case that has been here previously. See, e.g., Spraggins v. State, 243 Ga. 73 (252 S.E.2d 620) (1979). After Spraggins was granted habeas corpus relief by the Federal Court of Appeals for the 11th Circuit, on the ground of ineffective assistance of counsel, his case was returned to our state courts for a retrial.
