Charles Haight filed an action for malicious prosecution against Dr. John Godes and Martin Handweiler, Godes's attorney, based on a previous action from which Godes had voluntarily dismissed Haight. The issue of whether the dismissal constituted a favorable termination was bifurcated and tried first.
