This is an appeal by the Director of the Ohio Environmental Protection Agency ("director") from a decision by the Ohio Environmental Board of Review ("EBR") ordering the director to vacate the adoption of Ohio Adm. Code 3745-21-09(AA), which regulates operations of and emissions from commercial drycleaning establishments utilizing the chemical solvent perchloroethylene ("perc").
