This omnibus motion primarily concerns the sufficiency of a complaint which charges the defendant, Darryl Carrington, with unauthorized use of a vehicle (Penal Law § 165.05).

According to the complaint, sometime prior to March 31, 1987, defendant rented a car from Budget Rent-a-Car and agreed to return the car on March 31. He failed to do so and Budget Rent-a-Car reported...
