Plaintiff Dennis Fountain is a white police officer for the City of Waycross, Georgia. He alleges that he was denied equal protection of the law when a black police officer was promoted instead of him to the rank of sergeant pursuant to an affirmative action plan adopted by the City of Waycross. Before the Court are cross-motions for summary judgment.
