This matter is before the Court on the motion for summary judgment of third-party defendant Elizabeth Farquhar (hereinafter Farquhar). Upon consideration of the motion, the opposition and reply thereto, and the entire record herein, the Court concludes that there remain genuine issues of material fact and that Farquhar is not entitled to judgment as a matter of law.
