Springs sued First National Bank of Cut Bank ("Bank") which had refinanced the purchase of his home. His theories of liability were based on negligence and bad faith, under the tort law of Montana. The district court granted summary judgment to the Bank on November 14, 1986. Springs later moved for a new trial.
