Defendant Anthony F. Vap appeals from his conviction on one count of knowingly making false material declarations under oath ("perjury") before a federal grand jury, in violation of 18 U.S.C. § 1623. The perjury occurred during a 1985 grand jury investigation (the "Evans investigation") of corruption that targeted Evans & Associates Construction Co.
