Following a jury trial, defendant was convicted of assault of an employee of a place of confinement, MCL 750.197c; MSA 28.394(3). A bench trial followed and defendant was convicted of being an habitual offender, third felony conviction, MCL 769.11; MSA 28.1083. Defendant was sentenced to two to four years imprisonment. The trial court immediately vacated that sentence and sentenced defendant to a term of two to eight years on the habitual offender...
