MEMORANDUM OPINION AND ORDER

SHADUR, District Judge.

Terence Gatlin ("Gatlin") has sued his ex-employer Jewel Food Stores ("Jewel"), asserting:

1. a violation of the Civil Rights Act of 1866, 42 U.S.C. § 1981 ("Section 1981") and 2. a pendent state law claim for slander.
